Justice Ahmad Nadeem Arshad announced the verdict after hearing constitutional petition No.19774 of 2019, in which the petitioner had challenged a trial court order granting interim restraint in favour of Ali Zafar. The court ruled that freedom of expression does not permit repetitive or unverified allegations that harm another individual’s dignity when the matter is under judicial consideration.

In its detailed judgment, the court placed strong reliance on Article 14 of the Constitution, which guarantees the inviolability of human dignity. The bench observed that continued public statements could amount to a parallel media trial, a practice the law does not allow.

The court further held that reputation qualifies as a fundamental constitutional value and that interim injunctions remain justified in exceptional defamation cases where reputational harm cannot be compensated through monetary damages alone.

Importantly, the Lahore High Court directed the trial court to decide Ali Zafar’s defamation suit expeditiously and preferably within 30 days, noting that the case has already reached the stage of final arguments.

The judgment reinforces judicial limits on public commentary in ongoing legal disputes and affirms that constitutional protections apply equally to dignity and free speech.
